Dear Sir/Madam,
My mother got primary teacher (for Nursery/KG) post in a non recognised private school in March, 1990 after my fathers death who was working in the school as part time accountant. My mother does not have requisite qualification for the post.
During the last 24 years of her job the management of the school keep changing. But last year in December, 2013 the management told my mother to give her qualification proofs as per the post till March, 2014 or give her resignation. As you know that it is not possible to attain a particular qualification (for the post it is 10+2 and NTT/JBT/DIET) from 0 at such age.
We requested the management to review their decision but they discarded our request. My mother visited the school during April and May, 2014 (Till summer vacations) but the principal neither gave her any students for class nor allowed her to sign the attendance register. They also never gave anything in written. Her PF is being deducted by the School.
We gave a letter in Directorate of Education in April, 2014 but they replied verbally only that as the school is not recognised they con not do anything.
Now we want to know that
1) Can we file a case for her reinstatement with retrospective effect from 01/04/2014, in Delhi School Tribunal if the school is not recognised? If not What should we do? If Yes what is the procedure?
2) Is PAN card considered a valid proof of Date of Birth if they say that my mothers' age is over retirement age because they along with my mother, told the same thing to another teacher whose only 2 years of service are pending and she gave her resignation? My mothers' age is 54 Years as per PAN card.
3) They also did not give my mothers' March, 2014 Salary along with the increment which the management announced in March, 2014 for the period 2013-14 as we gave letter to Directorate of Education. The management of the non recognised school runs another school with the same name which is upto 12th standard and also recognised by the Delhi Govt.
Please help and advise us in the matter.
